COMUNICADO DE LOS VENEZOLANOS EN EL EXTERIOR

DENUNCIAMOS UN GOLPE DE ESTADO AL EJERCICIO DEL DERECHO ELECTORAL DE MILLONES DE VENEZOLANOS

En decisión que ratifica la voluntad totalitaria del régimen actual venezolano de evitar contarse,  la mayoría oficialista del Directorio del CNE, en el empeño de eludir sus responsabilidades, ha trasladado a los ciudadanos la verificación definitiva de las firmas en abierta violación de la Constitución y de las normas del referéndum revocatorio aprobadas por el directorio en las cuales se decía que sólo se requería del elector la firma y la huella, enviando al Comité Técnico del Consejo Nacional Electoral,  para ser colocadas en observación,  213.000 planillas de la solicitud que hicieran 3.467.050 venezolanos para llevar a efecto el Referendo Revocatorio Presidencial.

Al legislar sobre hechos cumplidos para  consumar un fraude gigantesco se complementa negando la presunción de inocencia, que es la base de todo sistema jurídico, y transformándola en presunción de culpabilidad al invertir la carga de la prueba.
 
Igualmente, con tres votos contra dos, la mayoría oficialista al saberse derrotada por la voluntad popular de los venezolanos rechazó la sensata sugerencia de la OEA y del Centro Carter de verificar a través de un muestreo aleatorio la legitimidad de las firmas.
 
Ante tan flagrante violación de los principios constitucionales,  de sus propios  reglamentos, del acuerdo firmado el 29 de mayo del 2003 en la Mesa de Negociación que tiene como garantes a la OEA, Centro Carter y las Naciones Unidas,  de la Carta Democrática y de la soberanía popular por parte del Consejo Nacional Electoral y dado que la voluntad de millones de ciudadanos pueda ser burlada mediante los famosos “tricks” mencionados por el ex presidente Carter.
 
Frente a estas decisiones y acciones ilegítimas estamos todos los venezolanos dispuestos a lograr que el Referendo Revocatorio se realice de acuerdo con las reglas originales decididas el pasado 20 de noviembre y avaladas por la comunidad internacional. Un país que va a seguir luchando por revocar el hambre, el desempleo, por alcanzar salud, trabajo, vivienda y educación para todos.

Consideramos:

 1.- Que  la exigua mayoría oficialista del CNE, ha alterado las reglas del proceso cuando este ya se encuentra en etapa avanzada, para así impedirlo y sabotearlo.

2.- Que hasta tanto no se produzca una profunda rectificación de los terribles errores en que incurrió la mayoría oficialista no serán reconocidos por la oposición venezolana como calificados para la conducción de proceso electoral alguno.

  3.-  Que esta absurda decisión no sólo descalifica a la mayoría oficialista del CNE, sino que además deslegitima al Gobierno pues desde las alturas del Poder Ejecutivo y usando al CNE como instrumento, se ha producido un golpe de estado contra la Constitución y contra la soberanía popular. En consecuencia, el Gobierno Nacional ha perdido su precaria legitimidad pues, aunque tuvo su origen en un acto electoral, ha maniobrado para evitar que la voluntad electoral se exprese libremente sobre su permanencia en el poder, tal como lo establece la Constitución Nacional.

International Venezuelan Council for Democracy (IVCD), Resistencia Civil de Venezolanos en el Exterior (Recivex) SA.VE Venezuela y organizaciones aliadas manifiestan su rechazo a la manipulación de la verdad hecha por el Gobierno Nacional, al igual que rechazamos toda violación a las leyes y normativas que regulan la expresión libre de la voluntad ciudadana y política dentro de la convivencia democrática.

  Por ello:
 
1.- Nos declaramos en emergencia ciudadana ante la consumación de una violación constitucional que desligitima al actual régimen, hasta que se restituya el equilibrio democrático.

2.- Exhortamos a todos los venezolanos de vocación democrática que ocupan y ejercen espacios institucionales en el CNE, Asamblea Nacional, Consejos Legislativos Regionales, Consejos Municipales, sindicatos, gremios, etc., a utilizar tales espacios para denunciar de manera firme y beligerante el fraude perpetrado contra la voluntad ciudadana, y hacer que la actividad de tales organismos esté centrada en este tema hasta que se produzca el restablecimiento pleno de la legalidad democrática en el proceso revocatorio venezolano.

3.-  Llamamos a todos los ciudadanos democráticos del mundo a iniciar acciones de respaldo a estas denuncias mediante pronunciamientos públicos ante los organismos internacionales, embajadas, consulados e instancias que se consideren susceptibles de ser impactadas por nuestras denuncias sobre el fraude cometido por el oficialismo totalitario del CNE y por el gobierno contra la voluntad popular venezolana.

4.- Exigimos al Tribunal Supremo de Justicia (TSJ) y a la Fuerza Armada Nacional (FAN) que actúen institucionalmente ante lo que consideramos una violación a la Constitución Nacional, a las leyes y reglamentos vigentes en Venezuela, para que así pueda restituirse el orden y equilibrio democrático en el país.

  5.- Respaldamos la posición asumida por la Misión de Observadores de la OEA, apoyamos su propuesta de instrumentar un estudio muestral para solventar las diferencias de opinión con relación a las planillas que presenten caligrafía similar, y les instamos para que junto al Centro Carter, a la Organización de las Naciones Unidas, a la Unión Europea, a los presidentes del Grupo de Países Amigos y del G15 y a todos los demás actores de la comunidad internacional ejerzan toda la presión moral, jurídica e institucional que sea posible a fin de lograr que el actual régimen retroceda en su empeño de violar la Constitución Nacional y se someta al dictado de la soberanía popular.

6.- Proponemos a los gobiernos y organizaciones del mundo que apoyen la propuesta de la OEA, que de manera imparcial contribuye a verificar la voluntad de los venezolanos, en lugar de desconsiderar más de un millón de firmas y huellas digitales, y con ello poner en peligro dramático la democracia, la libertad y el estado de derecho.

COMMUNIQUE

 WE DENOUNCE A COUP D'ETAT AGAINST THE EXPRESSION OF ELECTORAL RIGHTS OF MILLIONS OF VENEZUELANS

With a decision that confirms the totalitarian intent of the present Venezuelan regime in order to avoid a Presidential Recall Referendum, the pro-government majority of the CNE board of directors, in its determination to dodge its responsibilities, has transferred to the citizens the final verification of the petition signatures, flagrantly violating the Constitution and the norms of the recall referendum approved by the board, which stated that only signatures and fingerprints were required, by sending to the Technical Committee of the National Electoral Council (Consejo Nacional Electoral, or CNE), to be placed under observation, 213,000 petition forms of the request made by 3,467,050 Venezuelans to carry out the Presidential Recall Referendum.

The CNE has become complicit in a devastating electoral fraud by creating new norms after the collection of signatures and not previously agreed upon by the interested parties, and has compromised itself by denying the presumption of innocence and good faith of the signors, a principle that is the basis of all democratic judicial and electoral systems, moreover transforming it into a presumption of culpability and reversing the burden of proof.

Likewise, with three votes against two, the pro-government majority aware, of having been defeated by the popular will of the Venezuelan citizens, rejected the sensible suggestion from the OAS and the Carter Center to verify the authenticity of the signatures by means of a random sampling.

In view of such flagrant violation of the constitutional rights, of its regulations, of the agreement signed on May 29, 2003 at the Negotiations' Table, which has the OAS, the Carter Center and the United Nations as guarantors, of the Democratic Charter and of the people's sovereignty on behalf of the National Electoral Council (Consejo Nacional Electoral), and because the will of millions of citizens may be violated through the infamous "tricks" mentioned by ex-President Carter,

Given these decisions and other illegitimate actions, all Venezuelans are determined to achieve the execution of the Recall Referendum according to the original rules approved last November 20th and endorsed by the international community. Venezuela as a country will continue fighting to defend the basic human rights of its citizens, and to improve the political, social and economic climate for all.

Whereas:

1.- The slim pro-government majority of the CNE has altered the rules of the process at a time when the latter is at an advanced stage in order to hinder and sabotage it.

2.- Not until a major rectification of the terrible errors incurred by the pro-government majority takes place, the Venezuelan opposition shall not acknowledge these CNE members as qualified persons to conduct any electoral process whatsoever.

3.-  This absurd decision not only disqualifies the pro-government majority of the CNE, but moreover it renders the Government illegitimate, since from the Executive Power and using the CNE as instrument, a coup d'etat was perpetrated against the Constitution and the people. Consequently, the National Government has lost its precarious legitimacy because, even though it originated from an electoral act, it has maneuvered to avoid the electoral will to be expressed freely about its continuance in power, as established in the National Constitution.

The International Venezuelan Council for Democracy (IVCD), Resistencia Civil de Venezolanos en el Exterior (RECIVEX) and allied organizations express their rejection to the manipulation of truth made by the National Government, and reject as well any violation of the laws and regulations that establish the free expression of civil and political will within the democratic coexistence.

Therefore:

1.- We declare ourselves in civil emergency in view of the perpetrated constitutional violation that renders the present regime illegitimate, until the democratic balance is reestablished.

2.- We urge all democratic Venezuelan citizens who occupy and exercise institutional posts in the CNE, the National Assembly, Regional Legislative Councils, Municipal Councils, labor unions, professional groups, and others, to use said spaces to denounce firmly and belligerently, the fraud committed against the people, and to center the activities of such entities on this subject until the democratic legitimacy in the Venezuelan recall process has been fully reestablished.

3.-  We call on all democratic citizens of the world to initiate support actions in favor of these complaints by means of public statements before the international organizations, embassies, consulates and instances considered to be susceptible to be profoundly impacted by our denunciation about the fraud perpetrated by the totalitarian pro-government sector of the CNE and by the government against the will of the Venezuelan people.

4.- We demand from the Supreme Court (TSJ) and from National Armed Forces (FAN) to act institutionally before what we consider a violation of the National Constitution, of the laws and regulations in force in Venezuela, in order to reinstate the democratic order and balance in the country.

5.- We back the position assumed by the Mission of Observers from the OAS, and support their proposal to implement a statistical sampling of the forms in question in order to resolve the differences of opinion with respect to the forms that have similar calligraphy, and we urge its members to exercise all possible moral, judicial and institutional pressure, together with the Carter Center, the Organization of the United Nations, the European Union, the presidents of the Group of Friends and the G15 and other actors of the international community to make the present regime back down from its insistence on violating the National Constitution and to submit to the dictates of the people.

6.- Finally, we propose to all governments and world organizations to support the OAS proposal, which contributes impartially to verify the will of the Venezuelans, instead of rejecting more than one million signatures and fingerprints, thus dramatically endangering our democracy, liberty and government of laws.
